New customs evasion powers for importers
If enacted, Customs would be able to start an investigation on its own when it has information reasonably suggesting imported goods were entered through evasion of antidumping or countervailing duty orders. Those self-started investigations would follow the same rules as existing allegation and referral processes. If Customs finds you entered covered goods through evasion, you would only be able to seek court review after paying all liquidated duties, charges, and exactions. These changes would take effect upon enactment.
