HR6446119th CongressWALLET

To modify the procedures for investigating claims of evasion of antidumping and countervailing duty orders.

Sponsored By: Representative Kelly (PA)

Introduced

Summary

Creates authority for self‑initiated evasion investigations by letting the Commissioner open probes when information reasonably suggests covered merchandise entered the United States through evasion. The bill also would limit judicial review so a party could seek court review only after paying all liquidated duties, charges, and exactions.

Show full summary
  • Importers and traders: Could see more investigations because Customs could start probes without an outside allegation, and they would generally have to pay all liquidated duties before seeking judicial review.
  • Customs enforcement: The Commissioner would be able to use the same procedures that now apply to allegations and referrals under Section 517(b)(1) when opening self‑initiated investigations.
  • Courts and legal challengers: A person found to have entered covered merchandise through evasion would face a timing rule that conditions judicial review on payment of liquidated duties and related charges at the time review is sought.

New customs evasion powers for importers

If enacted, Customs would be able to start an investigation on its own when it has information reasonably suggesting imported goods were entered through evasion of antidumping or countervailing duty orders. Those self-started investigations would follow the same rules as existing allegation and referral processes. If Customs finds you entered covered goods through evasion, you would only be able to seek court review after paying all liquidated duties, charges, and exactions. These changes would take effect upon enactment.
