No federal lien on charter facilities
If enacted, the bill would say that funds made available under Part C do not create a Federal interest for two specific OMB rules. This would exempt Part C recipients from the recording requirement in 2 C.F.R. §200.316 and the reporting requirement in 2 C.F.R. §200.330. The change would take effect upon enactment and would apply to State entities and charter schools that get Part C funds.
More state help for charter facilities
If enacted, the bill would create a new competitive State Facilities Aid Program and change existing charter facility grants. State Facilities Aid grants would run up to five years and the Federal share would be no more than 60% of project costs. Grants must add to, not replace, non‑Federal funds; States could keep up to 5% for evaluation and technical help. The bill would also change one charter grant program: a referenced share would move from 90% to 80% and a State could reserve up to 10% of funds to start a revolving loan fund for facility loans. States that give charter schools access to tax‑exempt financing, public buildings, or land‑use parity would get priority.
