  • Air carriers and aircraft operators would be barred from accepting adult roosters for interstate or foreign carriage unless presented with certified documentation from a qualifying commercial farm. Carriers must refuse transport without that certification.
  • Commercial farms meeting the $350,000 threshold would be able to ship adult roosters for legitimate agricultural purposes if they provide financial records or attestations consistent with USDA Economic Research Service guidance. Documentation must be given to the carrier before transport.
  • Noncommercial shippers and other parties would lose the ability to move adult roosters by air across state lines or internationally except under the specified farm exemptions. Violations would carry civil penalties under chapter 463 of title 49 and enforcement would be led by the Secretary of Transportation in coordination with the FAA.

The prohibition would take effect 180 days after enactment.

New air-shipping ban and farm exemption

The person claiming the exemption would have to give financial records or an ERS-consistent attestation to the air carrier before transport. The ban, exemptions, and enforcement authority would take effect 180 days after enactment, and violations could lead to civil penalties under chapter 463.

States can keep stricter rules

This bill would say it does not stop States from having aviation safety laws that are stricter than the bill. States could keep or adopt tougher rules on the air transport of live animals. That non-preemption rule would take effect 180 days after enactment.
