  • Federal departments and agencies would be required to use the most recently published List when administering programs that reference critical minerals or critical materials.
  • The Secretary must publish the List within 45 days of enactment and update it within 45 days after any new designation. The Secretary and the Secretary of Energy must coordinate updates to keep the lists aligned.
  • The List must include any mineral the Secretary designates under subsection (c) and any non-fuel mineral, element, substance, or material the Secretary of Energy has determined to be a critical material under subsection (a)(2).

Unified list for critical minerals and materials

If enacted, the government would publish one official List within 45 days. It would include minerals named by the Secretary and materials already named by the Energy Secretary. The List would be updated within 45 days after either agency changes its designations. The two agencies would coordinate timing of updates when possible. Federal agencies that use these terms would have to use the newest List to run programs. The bill would also change one clause so "critical" covers both minerals and materials.
