Investigations and reports on Gaza attacks

If enacted, the bill would require the Secretary of State to tell Congress within 30 days whether there is credible information that the January 29, 2024 Gaza City attacks could be war crimes. If the Secretary makes that certification, the Secretary would have to refer the matter to the Attorney General within 15 days. The Attorney General would have to certify to Congress within 30 days that DOJ will review any such referral and, where U.S. courts have jurisdiction, pursue investigations or prosecutions for war crimes under 18 U.S.C. 2441 as appropriate. The bill would also require a joint report to Congress within 45 days listing all U.S. government information about the attacks. Federal agencies would be directed to collect, analyze, and preserve evidence from the October 7, 2023 war, including the January 29 attacks, for use in domestic, foreign, and international courts. The bill would name which congressional committees receive these reports and adopt statutory definitions for "atrocities" and "war crime."
