The Make DTE Pay Act would amend the Clean Air Act to add a new penalty rule. It would require a State or the Administrator to increase the amount of any penalty assessed against a noncomplying stationary source owned or operated by an investor-owned electric or gas utility by an amount equal to the original penalty for each rate increase the utility received in the two-year period preceding the original penalty assessment and that the utility seeks in the two-year period following the original assessment.

  • Investor-owned electric and gas utilities: would face larger fines when they received or sought rate increases in the two-year windows before and after a penalty.
  • State regulators and the EPA Administrator: could apply and collect these adjusted penalties against covered noncompliant stationary sources.
  • Rate proceedings: rate increases that are approved or pending before a regulatory authority are counted when calculating how much a penalty is increased.

Higher penalties for investor utilities

This bill would require the State or the EPA Administrator to raise penalties for noncomplying stationary sources owned or operated by investor-owned electric or gas utilities. For each utility rate increase that the utility both received in the 2-year period before the original penalty and seeks in the 2-year period after, the penalty would be increased by an amount equal to the original penalty assessment. Counted rate increases include those approved or pending before a regulatory authority. This rule would apply notwithstanding other parts of the same section and would take effect upon enactment.
