Show full summary
  • Families and mixed-status households: It would bar prorated or partial housing aid while any family member's status is unverified and require verification for all household members regardless of age.
  • Local governments and nonprofits: It would prohibit HUD grants to states, local governments, Indian tribes, or NGOs that provide housing to persons who are neither nationals nor lawfully admitted for permanent residence and would condition CDBG and HOME funding on complying with 8 U.S.C. 1373, honoring ICE detainers, and providing advance notice of removable noncitizens' releases.
  • HUD operations and programs: The Secretary of Housing and Urban Development would implement the expanded verification rules and enforce grant eligibility limits across HUD programs, eliminating prorated assistance during pending verifications.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 2 costs, 0 mixed.

HUD grants blocked for noncitizens

If enacted, HUD would be barred from using certain federal housing and community development grants to help people who are not U.S. nationals or not lawfully admitted for permanent residence. The bill would also bar HUD from awarding CDBG or HOME grants to states, local governments, tribes, or nonprofits that do not cooperate with federal immigration enforcement, honor ICE detainers, or fail to give advance notice of releases. The restriction on using section 106 grants would apply to grants made in fiscal year 2024 and later. This would put federal housing money at risk for programs that serve mixed-status or noncitizen households.

No prorated HUD aid pending

If enacted, the bill would require HUD to verify the immigration status of every household member, including children, before any prorated housing help is given. HUD would not be allowed to provide partial or prorated assistance to a household while any member's eligibility is still pending verification. The change would take effect upon enactment and could delay rent subsidies or other HUD aid for mixed-status families until all members are verified.
