  • Families of deceased service members would have more time to invest death benefits for tax-free growth or education planning, with a 3-year window and a retroactive rule for benefits received back to October 7, 2001.
  • The bill amends the Internal Revenue Code provisions that govern Roth IRAs and Coverdell Education Savings Accounts by striking "1-year period" and inserting "3-year period" to set the new contribution timeframe.

More time to save military death benefits

This bill would let survivors who receive military death benefits under 10 U.S.C. 1477 or 38 U.S.C. 1967 put those payments into a Roth IRA or a Coverdell Education Savings Account within three years after they get them. Currently the law limits this to one year. The change would apply to amounts received on or after the bill's enactment date. For payments received between October 7, 2001 and the enactment date, the bill would allow contributions if made before the later of (A) three years after you received the payment, or (B) one year after enactment.
