If enacted, this bill would define key terms by pointing to federal waste rules (40 C.F.R. 273.9) and define "lithium-ion battery" as a battery that uses lithium ions between electrodes. Destination facilities that store lithium‑ion batteries before recycling would have to follow certain universal-waste handler and storage rules (40 C.F.R. 273.33(a)(1), 273.35, 273.36, 273.37, and 273.60(b) or successors) instead of 273.60(a). The bill would also update the Mercury-Containing and Rechargeable Battery Management Act citation to refer to 40 C.F.R. part 273. Businesses that recycle, store, or handle end-of-life lithium‑ion batteries would see clarified and in some cases new compliance duties for storage, labeling, and tracking.
