Sponsored By: Representative Moore, Blake D. [R-UT-1]

In Committee

Summary

Broadens which beliefs count as religious for tax-exempt status. This bill would add a new rule to Internal Revenue Code Section 501 saying beliefs about marriage, sexuality, or gender identity cannot be treated as inconsistent with law or public policy. It would also say a belief does not need to be central to a religion or compelled by a religion to be treated as religious. The rule would apply to taxable years beginning after December 31, 2025.

Easier 501 status for religious groups

This bill would tell the IRS how to judge religious purpose when deciding 501 tax-exempt status. It would say beliefs or practices about marriage, sexuality, or gender identity must not be treated as inconsistent with law or public policy. It would also say a belief counts as religious even if it is not central to or compelled by a system of religion. These rules would apply to tax years beginning after December 31, 2025. If enacted, some religious organizations and their donors could find it easier to get or keep 501 tax-exempt status.
