Show full summary
  • Combat-disabled Chapter 61 retirees with fewer than 20 years who qualify for Combat-Related Special Compensation (CRSC) would be eligible to receive both military retired pay and Veterans Affairs disability compensation at the same time.
  • The bill ensures the retired pay of those eligible is not reduced under 38 U.S.C. 5304 or 5305 when those reductions would otherwise apply.
  • It renames and updates statutory headings and the table of sections and removes the existing phase-in provisions so the expanded concurrent receipt takes effect immediately for applicable payments.

Full retired pay for combat-disabled retirees

If adopted, you would get full retired pay if you are retired under chapter 61 and have under 20 years of creditable service. You must be eligible as a combat-related disabled retiree. The resolution would stop reductions to your retired pay under sections 5304 and 5305 of title 38. It would remove the existing phase-in so eligible retirees would receive concurrent receipt. The change would take effect the first day of the first month after enactment and apply to payments for months beginning on or after that date.
