Annual NEPA transparency report
If enacted, CEQ would publish an annual NEPA implementation report starting July 1, 2025. Each "covered year" would run from June 1 to June 1. The report would be posted on CEQ's website and sent to two congressional committees. It would list NEPA lawsuits and identify defendant agencies, lead plaintiffs, courts, and case outcomes, including awards of costs under 28 U.S.C. 2412. The report would show EIS and EA page counts, averages, medians, and quartiles. It would try to estimate total review preparation costs and list key milestone dates and timelines. It would list each agency's categorical exclusions and note changes during the year. Data would be broken down by project type and sectors like energy, transportation, and broadband. Agencies would be required to prepare the report.
