Right to sue over interstate farm rules

If enacted, the bill would let many people sue in federal court to challenge State or local rules that affect agricultural products sold across State lines. Eligible plaintiffs include producers, transporters, distributors, consumers, workers, trade groups, and governments. Plaintiffs could ask a court to block enforcement right away unless the government shows by clear and convincing evidence it will likely win and be irreparably harmed. Suits must start within 10 years and may be brought in federal district courts where the plaintiff is affected or does business. Plaintiffs could also seek money for economic losses caused by the rule.

Stops other States' farm rules

If enacted, the bill would bar a State or local government from imposing preharvest rules on farm production that happens in another State when the product is sold across state lines. The challenged rule could not be stricter than federal law and the laws where the product was grown. If no federal or production-State rules apply, that absence would count as the applicable standard.
