It would lift the base per-mile cap from $3,500 to $6,100 and use that higher amount to set the annual credit limit. The $6,100 figure would be adjusted for inflation for taxable years beginning after 2025 and rounded to the nearest $100. The bill would replace the old eligibility date so that gross maintenance expenses for tracks owned or leased as of January 1, 2024 count for the credit, instead of only tracks held as of January 1, 2015. These changes would apply to expenditures paid or incurred in taxable years beginning after December 31, 2024.

Larger rail maintenance tax credit

If enacted, rail carriers and contractors could use $6,100 instead of $3,500 as the base amount for the railroad track maintenance tax credit (Section 45G). For taxable years beginning after 2025, the $6,100 amount would be increased each year by the cost‑of‑living adjustment tied to section 1(f)(3), using calendar year 2024 for the first calculation. Any increase that is not a multiple of $100 would be rounded to the nearest $100. The bill would also change the date that defines qualifying track work from January 1, 2015 to January 1, 2024.
