  • U.S. exporters and suppliers: Trade or transfers involving the listed institute would face heightened export controls and added compliance requirements under U.S. trade rules.
  • The named Chinese forensic institute: Would be placed on the Bureau of Industry and Security's Entity List under its official name and two specified aliases.
  • Executive branch and oversight: The President could waive the listing through the Secretary of Commerce if, within 60 days, the President certifies to the Senate Committee on Commerce, Science, and Transportation and the House Committee on Energy and Commerce that the institute is not implicated in abuses tied to repression, mass arbitrary detention, forced labor, or high-technology surveillance of Uyghurs, Kazakhs, and other Muslim minority groups in Xinjiang.

Export limits on Chinese forensic lab

If enacted, this bill would require the Commerce Department's Bureau of Industry and Security to add the Ministry of Public Security's Institute of Forensic Science of China to the BIS Entity List no later than 60 days after enactment. The listing would identify two aliases: the Forensic Identification Center of the Ministry of Public Security of the People's Republic of China, and the Material Identification Center of the Ministry of Public Security of the People's Republic of China. Being on the Entity List would restrict exports and other transactions with the institute. U.S. companies that sell to the institute could face extra compliance costs or lost sales. The President, acting through the Secretary of Commerce, could waive the listing if, within 60 days, the President certifies to the Senate Commerce Committee and the House Energy and Commerce Committee that the institute is not engaged in activities contrary to U.S. foreign policy and is not implicated in Xinjiang-related human-rights abuses.
