Faster action on contaminated baby formula

If a finished infant formula test finds a covered microorganism, the maker would have to tell FDA within 1 business day. The maker would have to stop distribution, isolate or dispose of the product as FDA directs. The maker would have to send test results and isolates or genome data, and keep records available electronically. FDA would contact the maker within 1 business day and, within 90 days, confirm the investigation and fixes.

Regular reports and planning on formula supply

FDA would work with USDA and other agencies to meet near‑term needs and build a stronger formula supply. Within 180 days, FDA would report on carrying out its January 2025 market plan and list any added authority or funding needs. Not later than 270 days, FDA would send the first report with current supply data, like in‑stock rates, then report at least quarterly for 5 years. At 1, 3, and 5 years, FDA would consult the public and makers and report evidence‑based practices to improve safety and supply.
