This bill would authorize telehealth evaluations for certain substance use disorder prescriptions. It would add a new "telehealth evaluation" definition to the Controlled Substances Act and allow two-way audio-only or audio-plus-video telehealth consistent with the Social Security Act telehealth framework.

- People with substance use disorder: Would allow a telehealth evaluation to be used as part of the prescribing process for FDA‑approved Schedule III, IV, or V medications for treating substance use disorder, in addition to the required in-person evaluation.
- Clinicians (not pharmacists): Would be permitted to perform the telehealth evaluation from a remote location using the two-way real-time telecommunications system described in section 1834(m) of the Social Security Act. Either the distant-site practitioner or the treating practitioner may perform the evaluation.
- Regulators and telehealth services: Creates a statutory definition that ties telehealth evaluations to applicable federal and state laws and anchors allowed telehealth modes to the Social Security Act standard.

Telehealth visits for SUD medications
This bill would let you use one telehealth medical evaluation when getting an FDA-approved Schedule III, IV, or V drug for substance use disorder. You would still need at least one in-person medical evaluation. The telehealth visit could be audio-only or include video. A licensed practitioner (not a pharmacist) must do the telehealth visit. The telehealth visit would have to follow federal and state law and use the two-way system referenced in section 1834(m) of the Social Security Act. This change would take effect upon enactment.
