NOPAIN for Veterans Act
Sponsored By: Senator Shelley Capito
Introduced
Summary
Faster VA access to FDA-approved non-opioid pain treatments. This bill would require the Department of Veterans Affairs to add certain FDA-approved non-opioid drugs and biological products for postoperative, postsurgical or regional analgesia, or acute pain to its national formulary on a set timeline. It would also bar using the Cost of War Toxic Exposures Fund to implement the change.

Faster non-opioid drug access for veterans
If enacted, VA would be required to add qualifying non-opioid pain drugs and biological products to its national formulary quickly. The drug must be FDA-approved to reduce postoperative or acute pain and must not act on opioid receptors. VA would have to add the product by the earlier of: one year after it becomes eligible for certain Medicare payment rules or 18 months after FDA approval. VA would need to put the new definition and rules in place within 90 days of enactment. The bill would also bar using money from the Cost of War Toxic Exposures Fund to carry out these changes.
