Choose court for race discrimination

This bill would add a new Chapter 5 to the Federal Arbitration Act about race discrimination. It would define "race discrimination dispute" to include allegations of discrimination, harassment, or retaliation for race, color, or national origin. If enacted, a person bringing such a case or a named class representative could choose court instead of forced arbitration. A court, not an arbitrator, would decide if the rule applies or if an arbitration clause is enforceable. The rule would apply to cases filed under federal, tribal, state, or local law arising on or after enactment.
