Tougher penalties for robocalls and spoofing

This bill would make willful and knowing unlawful automated calls or texts a crime. A violator would face up to 1 year in jail and/or fines under title 18. Aggravated offenses could bring up to 3 years in jail if certain conditions apply. Those conditions include a prior conviction; initiating more than 100,000 calls in 24 hours, more than 1,000,000 calls in 30 days, more than 10,000,000 calls in one year; intent to use the calls to further a felony; or causing $5,000 or more in aggregate losses in a year. The bill would define a "call" to include automated calls, prerecorded-voice messages, and texts sent to phones without prior consent. It would also raise civil penalties for giving false caller ID from $10,000 to $20,000 per violation. These changes would take effect upon enactment and apply only to willful and knowing violations.
