Prescribers must be certified, cannot act in the role of a pharmacist, must accurately date pregnancies, diagnose ectopic pregnancies, provide or arrange surgical care and access to transfusion and resuscitation, and obtain patient acknowledgments of risks.
  • Manufacturers, researchers, and reporters would face strict limits and reporting rules. New investigational uses would be barred, any pre-enactment investigational exemption would end after 3 years if then prohibited, and manufacturers and prescribers must report adverse events and deaths to the FDA and manufacturers using non-identifiable references and package serial numbers. The bill also preserves state authority to impose additional abortion-drug restrictions.

Ban on abortion drug approvals and trials

If enacted, the bill would bar the FDA from approving any new marketing applications or generic approvals for drugs intended to cause abortions. It would also bar FDA investigational exemptions for abortion drugs or studies that knowingly destroy an unborn child. Investigational exemptions granted before enactment would be deemed rescinded three years after enactment if the Secretary would then be barred from issuing them.

Strict rules for approved abortion drugs

If enacted, the bill would impose strict safety rules on any abortion drug with FDA approval on the enactment date. Prescribers would need certification and specific clinical skills, and the drug could only be given in person by the prescribing practitioner at a clinic, office, or hospital. Labeling could not be changed to allow use after 70 days of gestation or to allow pharmacy or remote dispensing. Manufacturers and prescribers would have to report known adverse events to FDA and the manufacturer without patient names, and other health workers would also have to report adverse events to FDA. The bill would define key terms used for these rules, such as "abortion drug," "adverse event," and "gestation."
