Allow lawsuits for vaccine injuries
If enacted, this bill would let a person sue a vaccine manufacturer or administrator in State or Federal court for a vaccine-related injury or death starting on the date of enactment. It would repeal the Vaccine Program's election rule, standards of responsibility, and trial provision so claimants could pursue civil lawsuits instead of, or alongside, the federal Program. If a person gets compensation from the federal Vaccine Program for an injury, they would not be able to bring a civil lawsuit for that same injury. If a person gets damages by judgment or settlement in court, they would not be able to file a Program petition for that injury. The bill would also change timing and filing triggers so some deadlines depend on entry of judgment in the Court of Federal Claims instead of making an election.
Remove COVID vaccines from countermeasures
If enacted, the bill would change the law so the term "covered countermeasure" does not include any vaccine used to mitigate, prevent, or treat COVID-19. That means COVID-19 vaccines would no longer be treated as covered countermeasures for the program rules that affect liability and compensation. If you have an injury from a COVID-19 vaccine, this could let you seek different legal remedies than under the countermeasure rules.
