Tariff refunds for importers and small businesses

If enacted, this bill would require U.S. Customs and Border Protection (CBP) to refund, with interest, duties the President imposed under the International Emergency Economic Powers Act to each importer of a covered article. Refunds would be paid not later than 180 days after enactment and would apply notwithstanding section 514 of the Tariff Act or other law. For entries liquidated before enactment, CBP would reliquidate the entry at the duty rate that would have applied without the IEEPA duties to allow payment of refunds. CBP would issue guidance within 60 days on how to handle drawback claims for refunded duties. CBP would coordinate with the Small Business Administration, try to prioritize refunds to small business concerns, and share required documentation and timelines with them. CBP would report to specified Congressional committees starting 30 days after enactment and then every 30 days until all refunds are paid, showing counts, amounts, a small-business vs other-business breakdown, and an estimate to finish.
