Block Medicare payments to PE-owned hospitals
If enacted, this bill would bar Medicare payments to hospitals and skilled nursing facilities. The ban would apply when those facilities are owned or controlled by private equity funds, companies they control, or REITs. Control would include owning or having the power to vote 10% or more of voting securities, certain contracts, or other means the Secretary defines. Facilities owned or controlled by such firms on the enactment date would continue receiving Medicare payments for three years. Owners or affiliates of noncompliant facilities would be jointly and severally liable, and facilities would get notice and a hearing under section 1128(f).
