State and Tribal Hemp Opt-Out
If enacted, this bill would let a State or Indian Tribe tell the Agriculture Secretary it elects not to follow the federal hemp rules. The notice must go through the State department of agriculture in consultation with the Governor and chief law enforcement officer, or through the Tribal government. A State or Tribe that gives notice would be excepted from the federal plan requirement but would have to set a minimum age to buy hemp-derived cannabinoid products. The State or Tribe could define “hemp” and “hemp-derived cannabino product” under its own law, but would have to comply with the specified exclusion to the federal hemp definition in subparagraph (C)(iv)(I). The bill would also protect interstate shipments: opt-out jurisdictions could still send and receive hemp products, no State or Tribe could block transportation to or from a jurisdiction that follows federal rules, and when trade is between two opt-out jurisdictions the product must meet both jurisdictions’ laws. If enacted, these amendments would take effect on the effective date of the amendments made by section 781 of the Agriculture, Rural Development, Food and Drug Administration, and Related Agency Appropriations Act, 2026 (Public Law 119-37).
