States must verify ID or lose funds
If enacted, States would have to verify lawful presence for every applicant for a State driver’s license, commercial driver’s license, or State ID starting October 1, 2026. Verification would require an unexpired Department of Homeland Security document showing U.S. citizenship or lawful permanent residence. States would also have to use DHS-approved electronic checks of name, photo, and fingerprints, run FBI fingerprint checks, and confirm an applicant’s Social Security Number or ITIN with the IRS, SSA, or USCIS ELVIS. Starting October 1, 2026, the Secretary would withhold 10% of a noncompliant State’s annual highway apportionments under 23 U.S.C. § 104(b). Withheld money for the year would be split among compliant States in proportion to their usual shares, and a State that becomes compliant before year-end would get its withheld funds back on the date of compliance.
REAL ID rules stay the same
If enacted, this bill would not change any State requirement under title II of the REAL ID Act of 2005. States would keep their existing REAL ID duties and the new section would not alter those requirements.
