Sue companies for glyphosate and phosphorus harms

You would be able to sue in U.S. district court if you were harmed by exposure to elemental phosphorus or a glyphosate-based herbicide made, sold, or supplied in the United States. Courts would hear these cases regardless of the amount in controversy or the parties’ citizenship. You could seek compensatory damages (medical costs, lost income, pain and suffering, and wrongful death), punitive damages, injunctive or declaratory relief, and attorney’s fees and costs. The bill would define covered entities to include manufacturers, distributors, formulators, suppliers, sellers, contractors, and subcontractors. It would also waive federal immunities (including under the Defense Production Act) and bar covered companies from using federal-authority compliance as a defense. Claims arising before, on, or after enactment would be covered.

Block federal money for herbicide supply

The bill would prohibit any Federal funds from being obligated or spent to implement, administer, or enforce Executive Order 14387 on ensuring supplies of elemental phosphorus and glyphosate-based herbicides. Federal agencies would not be able to use appropriated money to carry out that Executive Order. If enacted, this would limit federal work to secure these chemical supplies and would affect availability or prices for farmers and consumers.
