  • Workers and families: More salaried workers would become eligible for overtime pay as the exemption floor rises to $45,000 on the effective date, then $55,000 in 2027, $65,000 in 2028, and $75,000 in 2029 before tying future thresholds to the 55th percentile of full-time salaried weekly earnings.
  • Employers and pay practices: Employers would face higher overtime exposure and must adjust pay or hours. The Secretary of Labor could set a higher threshold through notice-and-comment rulemaking if justified.
  • Data and administration: The Bureau of Labor Statistics must publish weekly earnings by census region each quarter. The overtime threshold would then be updated automatically each year based on the 55th percentile, with at least 60 days notice before changes take effect.
