Summary

Enhanced penalties for theft of firearms from Federal firearms licensees. This bill would make knowingly violating 18 U.S.C. § 922(u), or attempting to do so, punishable by fines, up to 20 years in prison, or both, impose minimum prison terms of 3 years when the theft occurs during the burglary of a licensed importer, manufacturer, or dealer and 5 years when it occurs during a robbery, and clarify definitions of "burglary" and "robbery".

Tougher penalties for gun dealer theft

If enacted, this bill would increase penalties for stealing firearms from licensed gun businesses. A person who knowingly violates, or attempts to violate, the theft rule would be fined and could be jailed for up to 20 years. If the theft happens during a burglary, the bill would require at least 3 years in prison. If it happens during a robbery, it would require at least 5 years in prison. The bill would define "burglary" as unlawful entry into, or remaining in, the business premises of a licensed importer, licensed manufacturer, or licensed dealer with intent to commit a crime. It would define "robbery" by reference to the federal robbery definition in 18 U.S.C. §1951(b).
