New Red Tape Hotline for Small Businesses

If enacted, the SBA Chief Counsel for Advocacy would have to set up and run a “Red Tape Hotline” within 180 days. If enacted, small entities would be able to report burdens from agency rules, guidance, policy statements, or other agency actions by email, web form, phone, or other methods. If enacted, the Chief Counsel would have to publish a website with those contact options and send a report to the SBA Administrator and to Congress within 1 year of enactment and then every year. If enacted, the annual report would list which rules or agency actions generated notifications and the affected industries; summarize who reported (type of small entity or organization, geographic area, and industry); identify the issuing agency and specific action; recommend ways agencies could reduce burdens on small entities; and summarize steps the Chief Counsel took, including any comments or analysis. For the hotline, the bill would use the definitions of “agency” in 5 U.S.C. §551 and “rule” and “small entity” in 5 U.S.C. §601.
