Veterans 2nd Amendment Protection Act of 2025
Sponsored By: Senator Kennedy, John [R-LA]
Introduced
Summary
Protects veterans' privacy by limiting when the VA can send beneficiary data to the federal gun background-check system. The bill would bar the Department of Veterans Affairs from transmitting personally identifying information to the Department of Justice for use by the National Instant Criminal Background Check System solely because the VA appointed a fiduciary, and would permit sharing only when a judge, magistrate, or other judicial authority finds the veteran or beneficiary is a danger to themselves or others.

Protect veterans' gun-purchase privacy
If enacted, this bill would stop the Department of Veterans Affairs from sending a beneficiary's personally identifying information to the Department of Justice for use by the federal gun background check system when the only basis is that the VA pays benefits to a fiduciary. The VA could still share that information if a judge, magistrate, or other judicial authority finds the beneficiary is a danger to themselves or others. This would not change the VA's authority to pay benefits to fiduciaries — it only limits automatic data sharing for background checks. The rule would take effect upon enactment.
