Ban on silicosis lawsuits against makers
If enacted, the bill would bar bringing any "qualified civil action" in any Federal or State court. It would require courts to dismiss qualified civil actions that are pending as soon as practicable after enactment. Covered suits are those against manufacturers or sellers for silicosis or related illnesses from worker exposure during fabrication. The ban would not apply to cases where the manufacturer or seller was the injured person's employer.
Definitions of covered products and makers
If enacted, the bill would define key terms used in the ban. "Fabrication" would include cutting, drilling, shaping, polishing, grinding, and similar work. A "qualified product" would be a stone slab product (including quartz, glass, porcelain, and similar materials) shipped in interstate or foreign commerce whose fabrication is covered by Federal or State workplace-safety rules for respirable crystalline silica. "Seller" would include importers, distributors, retailers, and suppliers. "State" would include all States, DC, Puerto Rico, the U.S. territories, and their political subdivisions. These definitions would take effect upon enactment.
