New state clean-water funding formula
If enacted, the bill would require the EPA Administrator to publish an initial allotment formula and state funding amounts in the Federal Register by September 30 of the first fiscal year after the first Clean Watersheds Needs Survey is published following enactment. Before making state allotments each year, the Administrator would set aside at least 0.1% for Buy American oversight, 2% for Indian tribes (under section 518), and 1.5% for U.S. territories (matching what each territory got in FY2026). Of the remaining money, 60% would be allotted based on state needs from the most recent Clean Watersheds Needs Survey, 20% by state population, and 20% by the share of people at or below 200% of the Federal poverty level (ACS 1-year). For the first fiscal year after the initial formula publication and each of the next three fiscal years, a state’s allotment would not rise by more than 200% or fall by more than 25% from its prior year amount. The bill would also add clear definitions for terms used in these rules and say the new rules do not change any money or allocations already provided under Division J of the Infrastructure Investment and Jobs Act for section 205 or title VI.
States can use grants for surveys
If enacted, the bill would let a State use up to 0.5% of the capitalization grant funds it receives each fiscal year (from this title and section 205(m)) to pay for work needed for the Clean Watersheds Needs Survey. The bill would also explicitly list technical assistance as an eligible use. This permission would apply even if other capitalization grant rules say otherwise.
