Limited antitrust safe harbor for AI

This bill would let two or more private entities share information or agree to delay or limit AI releases to reduce defined AI security risks. For coordinated delays, the bill would require a written notice to the Assistant Attorney General describing the specific risk and scope before taking action. The exemption would be an affirmative defense in antitrust suits, and entities would bear the burden to prove by a preponderance of the evidence they acted in good faith only for security. The Attorney General could still seek injunctions, and the bill would not permit price‑fixing, market allocation, or similar core antitrust violations. Information sent to the Assistant Attorney General would be treated as voluntarily shared and withheld from public disclosure under federal records law. If enacted, this would take effect upon enactment.
