New federal crime for fleeing drivers

If enacted, this bill would create a new federal crime for driving a vehicle within 100 miles of the U.S. border while intentionally fleeing certain law enforcement. The bill targets fleeing from a U.S. Border Patrol agent or officers assisting Border Patrol. The basic penalty would be up to 2 years in prison, a fine, or both. If serious bodily injury results, prison would be 5 to 20 years; if death results, 10 years to life.

Immigration penalties for fleeing drivers

If enacted, the bill would make a conviction for the new fleeing-by-vehicle offense a ground to deny admission to noncitizens and to deport them. It would also make a conviction or an admission of having committed the offense a bar to asylum and other immigration relief. The rule applies when an alien is convicted, admits committing the offense, or admits acts that amount to the offense. If passed, affected noncitizens could be removed or refused entry on that basis.
