Presumptive cancer benefits for officers

If enacted, the bill would create a rebuttable presumption that certain listed cancers diagnosed in public safety officers are line-of-duty injuries. You would qualify only if you began service at least 5 years before diagnosis and were diagnosed within 15 years of your last active service. The bill names many cancers (for example, lung, leukemia, mesothelioma, melanoma, prostate, breast) and says a carcinogen means an IARC Group 1 or 2A agent. The change would apply to deaths on or after January 1, 2020 and to disability claims filed on or after January 1, 2020. Claimants would also get a 3-year window from enactment to file claims tied to this change.

Expanded privacy and clearer cross-references

If enacted, the bill would broaden confidentiality for information given to the Office of Justice Programs and treat that change as if effective December 27, 1979. The bill would let OJP share or protect records more widely and cover information tied to any person or entity. It would also update legal cross-references to include the new subsection (b) so related rules align. These changes apply to matters pending when the bill is enacted.

Process to add and review cancers

If enacted, the Director would have to review the list of exposure-related cancers at least once every 3 years. The Director could update the list using medical evidence and studies from groups like NIOSH or the National Academies. Anyone could petition to add a cancer and the Director must send qualifying petitions to medical experts within 180 days. The Director must tell the House and Senate Judiciary Committees within 30 days after taking substantive action.
