Highest and Best Use, a Jury Issue

Anything in this article to the contrary notwithstanding, the highest and best use of the property sought to be acquired shall be determined by a jury, if a trial by jury has been demanded. (Acts 1985, No. 85-548, p. 802, §1005.)
