In this article, unless the context otherwise requires: 1. "Inspector" means the state mine inspector. 2. "Interested parties" means all persons who have filed written notice with the inspector of their desire to receive the notices provided for in this article.

The inspector shall administer this chapter and may adopt rules reasonably necessary to effectuate the provisions of this chapter.

Except as provided in this article, in adopting rules, the inspector shall comply with the procedures set forth in title 41, chapter 6.

At least twenty days prior to the adoption of any rule, copies of the notice filed with the secretary of state pursuant to section 41-1022 shall be mailed to all interested parties.

In cases where, in the opinion of the inspector, the enforcement of any order or rule would not materially increase the safety of employees and would cause undue hardship on an operator, exceptions may be made at the discretion of the inspector. To be effective such exceptions sh…
