Stop-work orders

Ark. Code Ann. § 14-1-510 — under General Provisions.

Ark. Code Ann. § 14-1-510

(a) If a local government official responsible for building code enforcement determines that a project does not comply with the applicable regulatory requirements, the local government official may:(1) Deny the permit or request for a certificate of occupancy or certificate of completion, as appropriate; or(2) Issue a stop-work order for the project or any portion of the project as provided by law after:(A) Providing notice to one (1) of the following individuals:(i) The owner;(ii) The private professional provider of record; or(iii) The contractor of record;(B) Posting a copy of the order on the site of the project; and(C) Providing the opportunity to remedy the violation within the time set forth in the notice.

(1) Deny the permit or request for a certificate of occupancy or certificate of completion, as appropriate; or

(2) Issue a stop-work order for the project or any portion of the project as provided by law after:(A) Providing notice to one (1) of the following individuals:(i) The owner;(ii) The private professional provider of record; or(iii) The contractor of record;(B) Posting a copy of the order on the site of the project; and(C) Providing the opportunity to remedy the violation within the time set forth in the notice.

(A) Providing notice to one (1) of the following individuals:(i) The owner;(ii) The private professional provider of record; or(iii) The contractor of record;

(i) The owner;

(ii) The private professional provider of record; or

(iii) The contractor of record;

(B) Posting a copy of the order on the site of the project; and

(C) Providing the opportunity to remedy the violation within the time set forth in the notice.

(b) A local government official shall be available to meet with the private professional provider within two (2) business days after issuing a stop-work order under subdivision (a)(2) of this section to resolve any dispute after issuing a stop-work order or providing notice to the applicant denying:(1) A permit;(2) A request for a certificate of occupancy; or(3) A certificate of completion.

(c) If the local government official and the private professional provider are unable to resolve the dispute or meet within the time required under subsection (b) of this section, the matter shall be referred to the local governing body, which shall consider the matter by whichever occurs first:(1) The next scheduled meeting of the local governing body; or(2) Within thirty (30) days from the date the matter is referred.
