(a) (1) Funds appropriated for the various state agencies, authorities, boards, commissions, departments, and institutions of higher education listed in this section shall not be used to purchase, lease for over thirty (30) days, operate, repair, or provide services for more than the maximum number of passenger motor vehicles as stated in this section, except in an emergency as proclaimed by the Governor.(2) (A) As used in this section, “passenger motor vehicles” means vehicles licensed for highway use, including without limitation automobiles, trucks, and vans, that do not require a commercial driver's license to operate.(B) As used in this section, “passenger motor vehicles” does not include vehicles that are primarily used for purposes of providing health screenings or providing health treatment.(3) Mileage reimbursement for employees' utilization of their personal automobiles is not included in this restriction.Click here to view table.

(b) (1) The General Assembly recognizes that, in some cases, motor vehicles are donated to educational institutions and agencies primarily for use in automotive repair and maintenance courses and in instructional programs for truck operators and that such motor vehicles are not normally used for other purposes by the educational institutions and agencies and should not be included in the maximum number of authorized passenger motor vehicles prescribed for such educational institutions and agencies in this section.(2) (A) Therefore, motor vehicles donated to educational institutions and agencies primarily for use in programs of instruction in automotive maintenance and repair, in operator training, and in related instructional programs shall not be included for the purpose of determining the number of passenger motor vehicles authorized for those educational institutions or agencies.(B) This section does not apply to motor vehicles donated under subdivision (b)(2)(A) of this section.
