(a) (1) Multiple award contracts may be made only if the State Procurement Director or an agency procurement official determines in writing that a single award is not advantageous to the State of Arkansas.(2) The determination under subdivision (a)(1) of this section shall state in writing a rationale and basis for the multiple award contract.(3) Multiple award contracts shall be limited to the least number of suppliers necessary to meet the requirements of the using agencies.

(b) If the director or agency procurement official anticipates that multiple award contracts will be made, the invitation for bids shall include a notification of the right of the Office of State Procurement or agency to make such an award and the criteria upon which such an award will be based.
