Ark. Code Ann. § 20-21-501

(1) As used in this subchapter:(1) “Chief executive officer” means the county judge of each county in this state;(2) “Cooperative agreement” means the written instrument which sets forth the conditions to be met by each county in order to qualify for grant funds authorized by this subchapter;(3) “Emergency planning zone” means the area surrounding a nuclear-powered electricity generating facility identified by the Division of Emergency Management for which special planning and preparedness efforts are carried out to ensure that prompt and effective protective actions can reduce or minimize the impact of releases of radioactive material for public health and safety;(4) “Failure to perform” means:(A) Utilization of grant funds which is inconsistent with the terms of the cooperative agreement;(B) Failure to demonstrate the capability to carry out the minimum responsibilities as defined in the cooperative agreement; or(C) Failure to adhere to the conditions or requirements of the cooperative agreement;(5) “Local government” means the cities, towns, municipalities, or other political subdivisions, or agencies thereof, located within a county in this state; and(6) “Radiological response plan” means the specific operational procedures to be performed by the citizens of each county in the event of either an actual or a practice nuclear emergency.

(4) “Failure to perform” means:(A) Utilization of grant funds which is inconsistent with the terms of the cooperative agreement;(B) Failure to demonstrate the capability to carry out the minimum responsibilities as defined in the cooperative agreement; or(C) Failure to adhere to the conditions or requirements of the cooperative agreement;

(B) Failure to demonstrate the capability to carry out the minimum responsibilities as defined in the cooperative agreement; or

(C) Failure to adhere to the conditions or requirements of the cooperative agreement;

(5) “Local government” means the cities, towns, municipalities, or other political subdivisions, or agencies thereof, located within a county in this state; and

(6) “Radiological response plan” means the specific operational procedures to be performed by the citizens of each county in the event of either an actual or a practice nuclear emergency.
