Sale or use of sky lanterns — Definition

(a) As used in this section, “sky lantern” means an unmanned free-floating device designed to contain an open flame.

(b) Except as provided in subsection (c) of this section, the sale or use of sky lanterns is prohibited.

(c) (1) A city of the first class or a city of the second class may issue an event permit for the use of sky lanterns if the event is open to the public.(2) The city of the first class or the city of the second class may revoke the permit under subdivision (c)(1) of this section at any time before the event if the fire department of the city of the first class or the city of the second class determines that the use of sky lanterns at the location of the event or on the date of the event, or both, would be dangerous due to weather or other conditions.
