Arkansas State Employee Student Loan Program — Definition

(a) (a) As used in this section, “state agency” means the same as defined in § 21-5-203.(b) There is established the Arkansas State Employee Student Loan Program to assist an eligible employee of a state agency with the repayment of student loans.(c) The program shall be administrated by participating state agencies from existing appropriations.(d) (1) To be eligible for the program, an employee shall:(A) Complete a six-month probationary period that begins with the employee's first day of employment with the state agency;(B) Provide proof that the employee incurred student loan debt for the purpose of obtaining a degree in a field related to the employee's employment position, including without limitation the name and address of the student loan creditor;(C) Provide proof that the student loan is unpaid at the time the employee applies for the program; and(D) Execute an agreement in which the employee agrees:(i) To continue employment with the state agency for a reasonable length of time as determined by the state agency; and(ii) That the state agency is not obligated to issue further payments under the program if the employee resigns or is terminated while participating in the program.(2) A state agency may provide for additional eligibility requirements by rule.(e) Payments under the program shall be made directly to the employee's student loan creditor subject to the following limitations:(1) Payments shall be issued in installments not to exceed two thousand dollars ($2,000); and(2) An employee may receive no more than:(A) Five (5) installment payments; or(B) A total of ten thousand dollars ($10,000) in payments.(f) Each state agency shall promulgate rules necessary to implement the program within the state agency, including without limitation rules regarding:(1) Eligibility for the program;(2) The payments an employee is eligible to receive; and(3) The management of the program within the state agency.
