Conduct constituting solicitation — Classification

Ark. Code Ann. § 5-3-301

(a) A person solicits the commission of an offense if, with the purpose of promoting or facilitating the commission of a specific offense, the person commands, urges, or requests another person to engage in specific conduct that would:(1) Constitute that offense;(2) Constitute an attempt to commit that offense;(3) Cause the result specified by the definition of that offense; or(4) Establish the other person's complicity in the commission or attempted commission of that offense.

(1) Constitute that offense;

(b) Criminal solicitation is a:(1) Class Y felony if the offense solicited is:(A) Capital murder, § 5-10-101;(B) Capital rape, § 5-14-114;(C) Aggravated death by delivery, § 5-10-202;(D) Predatory marketing of fentanyl to minors, § 5-64-421; or(E) Trafficking of fentanyl, § 5-64-440;(2) Class A felony if the offense solicited is treason or a Class Y felony other than capital murder or capital rape;(3) Class B felony if the offense solicited is a Class A felony;(4) Class C felony if the offense solicited is a Class B felony;(5) Class D felony if the offense solicited is a Class C felony;(6) Class A misdemeanor if the offense solicited is a Class D felony or an unclassified felony;(7) Class B misdemeanor if the offense solicited is a Class A misdemeanor;(8) Class C misdemeanor if the offense solicited is a Class B misdemeanor; or(9) Violation if the offense solicited is a Class C misdemeanor or an unclassified misdemeanor.

(1) Class Y felony if the offense solicited is:(A) Capital murder, § 5-10-101;(B) Capital rape, § 5-14-114;(C) Aggravated death by delivery, § 5-10-202;(D) Predatory marketing of fentanyl to minors, § 5-64-421; or(E) Trafficking of fentanyl, § 5-64-440;

(A) Capital murder, § 5-10-101;

(B) Capital rape, § 5-14-114;

(C) Aggravated death by delivery, § 5-10-202;

(D) Predatory marketing of fentanyl to minors, § 5-64-421; or

(E) Trafficking of fentanyl, § 5-64-440;

(2) Class A felony if the offense solicited is treason or a Class Y felony other than capital murder or capital rape;

(3) Class B felony if the offense solicited is a Class A felony;

(4) Class C felony if the offense solicited is a Class B felony;

(5) Class D felony if the offense solicited is a Class C felony;

(6) Class A misdemeanor if the offense solicited is a Class D felony or an unclassified felony;

(7) Class B misdemeanor if the offense solicited is a Class A misdemeanor;

(8) Class C misdemeanor if the offense solicited is a Class B misdemeanor; or

(9) Violation if the offense solicited is a Class C misdemeanor or an unclassified misdemeanor.
