Seizure of conveyances

(a) A conveyance subject to forfeiture under this subchapter may be seized by any law enforcement agent upon process issued by any circuit court having jurisdiction over the conveyance upon a petition filed by the prosecuting attorney of the judicial district.

(b) Seizure without process may be made if:(1) The seizure is incident to an arrest or a search under a search warrant; or(2) Any law enforcement officer has probable cause to believe that the conveyance was used in the commission or attempt of:(A) A burglary;(B) A robbery;(C) A theft; or(D) An arson.
