(a) It is unlawful for any person to solicit a donation or offer to sell any item or service:(1) On a state highway;(2) Within ten feet (10′) of a state highway, if there is not a sidewalk along the highway; or(3) Between the highway and a sidewalk, if there is a sidewalk within ten feet (10′) of the highway.

(3) Between the highway and a sidewalk, if there is a sidewalk within ten feet (10′) of the highway.
(b) A violation of this section is a Class C misdemeanor.
