(a) A person commits the offense of unlawful assembly if he or she:(1) Assembles with two (2) or more other persons; and(2) Has the purpose of engaging in conduct constituting a riot.
(1) Assembles with two (2) or more other persons; and

(b) Unlawful assembly is a Class C misdemeanor.
