(a) A person shall not sell, rent, or transfer a firearm to any person whom he or she knows is prohibited by state or federal law from possessing the firearm.
(b) (1) Violation of this section is a Class A misdemeanor, unless the firearm is:(A) A handgun;(B) An explosive or incendiary device, as defined in § 5-71-301;(C) A defaced firearm, as described in § 5-73-107; or(D) Other implement for the infliction of serious physical injury or death that serves no lawful purpose.(2) If the firearm is listed in subdivision (b)(1) of this section, a violation of this section is a Class B felony.
