Reduction in force procedure — Definition

(a) (1) It is the public policy of the State of Arkansas that each school district shall have a written policy on reduction in force based upon criteria for a layoff and recall of employees, which shall include without limitation an employee's:(A) Merit;(B) Ability;(C) Attendance;(D) Performance; and(E) Effectiveness.(2) The following shall not factor more than fifty percent (50%) of the total criteria used by a school district in its written policy on reduction in force:(A) An employee's seniority;(B) An employee's length of service with the school district;(C) An employee's total professional development hours; and(D) The education level of an employee.

(b) A “layoff” is an unavoidable reduction in the workforce beyond normal attrition.
